In accordance with ANSPDCP communication no. 0029586/20.12.2017, Metal Clay RO SRL nu is required when registering as a personal data controller in order to carry out the online trade activity.

Considering that from May 25, 2018 it is applicable European Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("Regulation","GDPR"), we want to inform you completely and correctly about the way we process and protect your personal data.

Why do we process personal data?

ARTKIMIA will process your personal data based on the following:

  1. Execution or conclusion of the contract with you and to respond to your requests. This also allows us to bill you based on the services you have used. Also, it may be necessary to carry out checks in order to develop the contracted projects, as well as verifications of the client's current services.
  2. The legitimate business interests of ARTKIMIA, for example, fraud prevention, improving our services. We will collect personal data:

  • Direct from the customer

ARTKIMIA may request other personal data for specific purposes, for example when the client provides a copy of an identity document at the time of the conclusion of a contract, with his consent.

Also, ARTKIMIA receives any information or content created by the client and actively offered by it (eg photos, etc.).

What does the automatic processing of personal data entail?

Any decision taken exclusively on the basis of automatic processing will be previously agreed or necessary for the conclusion of the Contract.

ARTKIMIA personalizes communication with its customers using personal data related to customer history, past options or service preferences.

The client will not be the subject of any decision based solely on the automatic processing of the data that produces legal effects in regard to or significantly affects it, unless the client has explicitly agreed to the processing or processing is necessary for the conclusion or conclusion of a contract concluded with ARTKIMIA (such as identifying eligibility for certain offers) to prevent fraud and debt, or  ARTKIMIA it is obliged by law to use personal data in this way.

In all cases, the client has the opportunity to request the explanation of the logic behind the automatic decision mechanism, and, where appropriate, the client may request human intervention in issuing the decision concerning him.

How do we protect your personal data?

ARTKIMIA implements appropriate security measures to guarantee the security of the client's personal data and has specific durations implemented, so that the personal data is kept as long as necessary to achieve the stated purpose

  • Data security

To guarantee the security of your personal data,  ARTKIMIA implemented a series of security measures that are in line with industry standards. They do not cover those personal data that the customer chooses to communicate in public spaces online or offline.

We will take reasonable technical and organizational precautions to prevent the loss, misuse or alteration of your personal information.

Thus,  ARTKIMIA may retain personal data for a reasonable period of time after the last customer interaction with  ARTKIMIA in accordance with the legislation in force.

When the client's personal data is no longer necessary for the purpose for which it was collected or approved and there is no legal obligation to keep it, ARTKIMIA it will destroy or erase them safely.

We have a specialized security person who is constantly analyzing and improving the measures we have taken to protect your personal data against any unauthorized access, accidental loss, disclosure or destruction.

Right of deletion

ARTKIMIA aims to process and store your data only for as long as necessary. In certain circumstances, you have the right to ask us to delete your personal data we hold. If you feel that we are keeping your data longer than necessary, it would be best to check with the Customer Service first, if your contract with ARTKIMIA. If this has ceased, we may continue to have legal grounds for processing your personal data (for more information regarding storage periods, see the "Data Retention" section).

These rights may be limited, in certain circumstances defined by law (eg the client may choose not to receive marketing communications, but may not request ARTKIMIA the personal data necessary for the execution of the contract will be deleted). In this respect, the client is a legal entity, as before transferring personal data of the users and of the contact person to ARTKIMIA, to obtain their consent for the processing carried out by ARTKIMIA in the execution of the contract and for the processing of the aforementioned data. Transferring the personal data of its representatives (ex: general manager, administrator, manager / contract person) to ARTKIMIA, the client legal person attests that their consent was obtained for the processing of their personal data by ARTKIMIA in accordance with the above provisions and assumes full responsibility for it.
